IS IT LEGAL?

 You’ve read the journals, trade publications and magazines. You may even have consulted one of the many companies that will take your money for telling you what you need to do to comply with the law, but in the end, ARE YOU SURE?

We can never be sure whether or not someone will sue you or charge you with Fraud and Abuse, or how a court will decide the issue. On the other hand, there is a step you can take to help protect yourself—get a Legal Opinion Letter.  This can be as small as a few pages, or as long as a small book, but in each case it examines what you are doing, compares it with both statutory, regulatory and case law, and gives you an opinion as to whether it is within the bounds of the law. Once you have this, you will have done your “Due Diligence,” and the likelihood that you will be required to pay penalties.

Think of this as an insurance policy that can keep you form loosing everything you’ve worked for.

HIPAA, ERISA, COBRA

As above, these are laws that have been extensively legislated, regulations promulgated, and had lawsuits prosecuted for a long time since their inception. A wonderful attorney once told me that there is no “black or white” in law, only shades of gray. Let us help you to keep the whiter shade of gray.
